Terms of Service
These Terms of Service govern your use of the Decimators learning platform. Please read them carefully. By creating an account or accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms. These Terms are written in plain language as required by Section 22 of the Consumer Protection Act 68 of 2008.
1. About Us
These Terms are an agreement between you and:
We are registered with the Companies and Intellectual Property Commission (CIPC) and are a South African private company. This disclosure is made in accordance with Section 43 of the Electronic Communications and Transactions Act 25 of 2002 (ECT Act).
2. The Service
Decimators is a browser-based mathematics education platform ("the Service") designed for learners aged approximately 5–10 years. The Service features:
- An interactive learning game where players engage with number concepts through gameplay;
- Multiple account types: Player (individual), Parent (managing child accounts), and Educator (managing classroom accounts);
- Progress tracking and scoreboard features;
- A parent and educator portal for account management.
Access to the full Service requires a paid prepaid subscription or a valid coupon code.
3. Accounts and Eligibility
3.1 Who may register
To register a paid account, you must be 18 years of age or older. By registering, you confirm that:
- The information you provide is accurate and complete;
- You will keep your login credentials confidential;
- You are responsible for all activity on your account.
3.2 Account types
- Player: An individual subscriber who accesses the game directly.
- Parent: An adult subscriber who manages child player accounts under one subscription.
- Educator: A school or individual educator who manages a classroom of student accounts.
- Child / Student: A sub-account created by a Parent or Educator. These accounts may not purchase subscriptions and are governed by their associated adult account.
3.3 Account security
You are responsible for safeguarding your password. Notify us immediately at support@decimators.app if you suspect unauthorised access to your account.
4. Children and Minors
Important: Child and Student accounts are created and managed by the adult account holder (Parent or Educator). By creating a child or student account, the adult account holder:
- Confirms they are the parent, legal guardian, or authorised educator of that child;
- Consents to the collection and processing of that child's limited personal information (username and in-app access credentials) as described in our Privacy Policy;
- Accepts responsibility for the child's use of the Service;
- Confirms that the child's use is supervised appropriately for their age.
We do not collect email addresses or contact information directly from children. All communication regarding child accounts is directed to the adult account holder. This approach complies with Section 35 of the Protection of Personal Information Act 4 of 2013 (POPIA).
Children do not interact with payment, marketing, or data collection features of the Service.
5. Prepaid Access and Payment
5.1 Prepaid model
Access to the Service is sold on a prepaid monthly basis. You pay in advance for one month of access. Your access remains active for 30 days from the date of payment. No automatic recurring charges are made — you will receive a renewal reminder before your prepaid period expires.
5.2 Pricing
Current pricing is displayed on the sign-up page. All prices are in South African Rand (ZAR) and include VAT where applicable. We reserve the right to change pricing; any change will be communicated to you at least 20 business days before it takes effect on your account.
5.3 Payment processing
Payments are processed securely by Yoco Technologies (Pty) Ltd. Decimators does not store your card details. Yoco's processing is subject to their own terms and security standards. By making a payment, you agree to Yoco's terms of service.
5.4 Coupon codes
Valid coupon codes may grant free access for a specified period. Coupon terms are set out at the time of issue and may not be combined with paid subscriptions.
6. Cooling-Off Period
In accordance with Section 44 of the Electronic Communications and Transactions Act 25 of 2002, you have the right to cancel an online transaction and receive a full refund within 7 (seven) days of the transaction date, provided you have not yet accessed the paid features of the Service.
Once you have accessed the game or created player usernames under your account, the cooling-off right does not apply, as the Service will be deemed to have been delivered.
To exercise this right, contact us at accounts@decimators.app within the 7-day period with your account email and transaction reference.
7. Cancellation and Refunds
7.1 Cancellation
Because our service is prepaid (not a fixed-term contract), you are not locked into any ongoing commitment. You simply choose not to renew when your prepaid period expires. There is no cancellation penalty.
To close your account entirely or request deletion of your data, contact accounts@decimators.app.
7.2 Refunds outside the cooling-off period
We do not offer refunds for unused portions of a prepaid period, except where:
- The Service is unavailable for more than 72 consecutive hours due to our fault;
- We are required to provide a refund by law (including under the Consumer Protection Act);
- We determine, at our sole discretion, that a refund is warranted in the circumstances.

8. Acceptable Use
You agree not to:
- Use the Service in any way that violates applicable South African law;
- Share your account credentials with persons outside your household or classroom;
- Attempt to reverse-engineer, copy, or reproduce any part of the Service;
- Use automated tools to access the Service (bots, scrapers, etc.);
- Upload, transmit, or distribute harmful, unlawful, or offensive content;
- Attempt to gain unauthorised access to any system, account, or data;
- Use the Service for any commercial purpose other than as expressly permitted.
We reserve the right to suspend or terminate accounts that violate these rules without notice or refund.
9. Intellectual Property
All content, design, code, graphics, game mechanics, characters, audio, and materials on the Service are the intellectual property of Decimators (Pty) Ltd or its licensors, protected under the Copyright Act 98 of 1978 and related legislation.
We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for personal or classroom educational purposes during your active access period. No other rights are granted.
You retain ownership of any content you submit to us (such as contact form messages), but grant us a licence to use that content to operate and improve the Service.
10. Availability and Disclaimers
We aim to provide a reliable service but cannot guarantee uninterrupted availability. The Service is provided "as is" and "as available". We do not warrant that the Service will be error-free, uninterrupted, or free from viruses or harmful components.
We will use reasonable efforts to notify subscribers of planned maintenance or downtime in advance via email.
Educational outcomes are not guaranteed. Decimators is a supplementary learning tool and should not replace formal education.
11. Limitation of Liability
To the maximum extent permitted by South African law, Decimators (Pty) Ltd will not be liable for:
- Indirect, incidental, or consequential loss or damage;
- Loss of data, profits, or business opportunity;
- Damage caused by third-party services (including Yoco or Firebase);
- Any loss arising from your failure to keep your account credentials secure.
Our total liability to you in any given month shall not exceed the amount you paid us in that month. Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence.
Your rights under the Consumer Protection Act are not affected by this clause.
12. Your Consumer Rights
The Consumer Protection Act 68 of 2008 (CPA) grants you the following rights, which these Terms do not limit or override:
- Right to quality service (Section 54): You are entitled to services performed in a manner consistent with what a reasonable consumer would expect.
- Right to fair and honest dealing (Section 40–41): We may not engage in unconscionable conduct or make false representations about the Service.
- Right to plain language (Section 22): All documents governing this relationship are written in plain language.
- Right to redress (Section 56): If the Service does not meet acceptable standards, you may request a remedy.
- Protection of vulnerable consumers (Section 3(1)(b)): We take particular care where our Service involves children.
If you have a complaint that we cannot resolve, you may contact the National Consumer Commission (NCC) at www.thencc.gov.za or the Consumer Goods and Services Ombud (CGSO).
13. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms will be resolved in a South African court with jurisdiction over Cape Town, Western Cape.
Before initiating formal proceedings, we encourage you to contact us at contact@decimators.app to resolve any dispute informally. We aim to respond within 5 business days.
14. Changes to These Terms
We may update these Terms from time to time. We will notify active account holders by email at least 20 business days before material changes take effect. Continued use of the Service after that period constitutes acceptance of the updated Terms.
